I have a court order appointing me as Legal Guardian for my brother Bomon Maneck Mehta who is suffering from schizophrenia. Being a mental patient he is not permitted by law to sign any documents. I, as Legal Guardian am permitted by the court order to conduct all his affairs under my authority as Legal Guardian.As his PPF Account with the Worli Sea Face Branch of State Bank of India has matured, we have to withdraw the amount standing in his name and close the PPF account. For this purpose I have asked the bank to issue a cheque in my brother’s own name as he is the holder of the PPF account.
The State Bank of India Worli Sea Face Branch Mumbai, insists that despite the court order my brother must sign the withdrawal form and identification documents. The original court order has been shown to them and inspected by the manager and staff. A copy has been provided to them. Copies of the Court Order and KYC documents also have been provided to them twice last year. We are willing to provide them to the bank again but being a mental patient he is not permitted to sign or self attest them. This would be contempt of court. They do not seem to understand the legal provisions of the court order. Could your Legal Department kindly explain to them not to insist on a mental patient’s signature but to accept the signature of the Legal Guardian appointed by the Court of Law.
